Sideband restrictions on channels 36 to 40 is a gentleman's agreement. Most guys run LSB on CB, while on 10 meter many prefer USB. In the end it is just a matter of choice. For some reason I like to use LSB no matter where I go, but if the majority are using USB I have no choice but to use that mode if I want to join the group's conversation.
Just my 2 cents, respectfully

I like Rick's answer, yes it was a gentleman's agreement. We picked LSB because back in the 23 channel days, channel 16, (27.155) was used for LSB. The reason was it was farther away from the nearest other frequency. Channel 15 was at 27.135 and channel 17 was at 27.165 (yes it is only 10kc away but remember you are going LSB). Channel 15A was 27.145, this let us slide toward 15A and get away from any interfering bleedover (most of the old SSB radios had unlocked clarifiers), some radios could slide right to it. It also was close to the center of the band (channel 16) so the antenna SWR would be at it's best. We attempted to take channels 22A and B as well as above 23 and below 1.

I do hear long Qso's on USB on 27.380 which is between channel 37 and 38. They are very clear when the skip is in there and 5kc's away from the noise. It may be illegal but they are out there. Their audio sounds real clear with fidelity and could be using modified ham gear with and EQ.
